General Terms and Conditions of Sale and Delivery

Article 1. Applicability
These General Terms and Conditions apply to all offers, orders, and agreements established with CAPRIFIT.
By placing an order, the customer agrees to these terms and conditions. This agreement becomes legally binding once CAPRIFIT has confirmed the order.
Any adjustments (including deviations or additions) to these terms must be confirmed in writing and apply only to the specific agreement for which they were drafted.
CAPRIFIT does not accept any other general terms and conditions unless explicitly confirmed by CAPRIFIT in writing.
Article 2. Prices & Promotions
All prices include VAT and exclude shipping costs (unless stated otherwise).
Prices and product information are provided with the utmost care. Errors or typographical errors are reserved and do not entitle the customer to delivery under incorrect terms.
In the event of an unrealistic price or promotion, for example, due to an incorrectly stated price, CAPRIFIT reserves the right to charge the correct price. The customer naturally has 14 days to exercise their right of withdrawal, provided the products meet the conditions described in Article 5.
All promotions from CAPRIFIT are non-binding and can be revoked at any time. This right remains valid until no later than 5 business days after receipt of an order.
Article 3. Ordering and Payment
Orders can only be placed through the webshop.
Payment must be made immediately upon ordering via the payment methods offered at that time (e.g., iDEAL, credit card, etc.). By using one of these payment methods, the terms and conditions of the respective provider apply.
Orders will only be processed once the payment has been received.
Article 4. Shipping & Delivery
Orders are shipped within 24 hours after payment, unless stated otherwise or in the case of exceptions [such as public holidays]. CAPRIFIT collaborates with various carriers to deliver an order to the specified address as quickly as possible. The general terms and conditions of the carrier apply to the transportation.
If a product is temporarily out of stock, the website will be updated as soon as possible. If this update has not occurred in time and a customer places an order, the customer will be notified within 24 hours, and the shipment will be delayed.
The risk of damage and/or loss of products rests with CAPRIFIT until the moment of delivery to the customer.
Article 5. Returns
The customer has the right to cancel the order within 14 days of receipt without providing a reason.
Exception: Sports nutrition and dietary supplements of which the seal has been broken after delivery cannot be returned for hygiene and health reasons. The same applies to products with a short shelf life.
Return shipments are at the risk and expense of the customer (unless stated otherwise), except if an error was made by CAPRIFIT (e.g., delivery of the wrong product).

Upon a correct return, the customer will receive a confirmation of receipt within 48 hours and a refund of the purchase amount within 14 days of receipt. This will be processed via the same payment method used by the customer, unless otherwise indicated.
Article 6. Warranty and Complaints
CAPRIFIT guarantees that the delivered products comply with the agreement and legal requirements.
If a product does not comply with the agreement, the customer has the option to exercise the right of withdrawal. This must be explicitly stated when reporting the return.
If the customer has a complaint, it must be reported to CAPRIFIT via email as soon as possible, but no later than 7 days after delivery. Complaints will be handled within 14 days. These can be sent to info@caprifit.com.
Article 7. Liability
Use of the products from CAPRIFIT is entirely at the customer’s own responsibility.
CAPRIFIT is not liable for any advice provided.
CAPRIFIT is not liable for damage, physical injury, or health issues resulting from the incorrect use of the products. Any form of compensation is therefore excluded.
The products are dietary supplements and are not a substitute for a varied diet or medical treatment. In case of doubt, always consult a physician or expert.
Article 8. Force Majeure
Force majeure is understood to mean any circumstance beyond the control and influence of CAPRIFIT which, whether foreseeable or not at the time of entering into the agreement, makes the fulfillment of obligations reasonably impossible. This includes (but is not limited to): war situations, government measures, shortage of raw materials, factory or transport disruptions of any kind, cyberattacks or ICT failures, strikes, labor shortages, quarantine, epidemics or pandemics, weather conditions such as frost delays, shortcomings of third parties (e.g., delayed deliveries by suppliers), or decisions by suppliers to cease services.
In the event of force majeure, CAPRIFIT has the right to terminate an agreement. This also applies to the fulfillment of its obligations.
Article 9. Partial Invalidity
If one or more provisions in these terms and conditions are not, or not entirely, legally valid, this shall have no impact on the remaining part of the agreement. Both parties will consult to find an appropriate arrangement.

CAPRIFIT processes personal data in accordance with applicable privacy legislation. More information can be found in our Privacy Policy.
Article 11. Applicable Law
All agreements and disputes are exclusively governed by Dutch law.
